Default stephen king - please read

I just finished a self-published book entitled "The Dark", written by Anthony Giangregorio, which is a direct rip-off of your book, The Mist. This book was printed in 2009. This book takes place in a small town in Massachusetts where a man lives there with his wife and small son. It seems that a giant wall of something black is closing off the town and in the dark are giant scorpions and other un-savory monsters from another dimension, that the man, who is stuck in a hardware store alone with his son, his ex-girlfriend and other people of town, must fight.
    Sound familiar?

On the surface, it does sound suspiciously close to "The Mist" but the plot description on Amazon didn't exactly match. I asked for more details from janisbsmith. It may or may not be plagiarism as there may be enough differences to make it its own spin on the idea of someone being trapped by monsters.

Is it any good? I've read very few books from the vanity presses...I've started many, but finished few.

    Is it selling?

Are there any damages, and is there any possibility of collection upon a judgment or default? Or does King potentially profit?

Too many unknown variables for a barebones legal analysis, and I'm not well-versed in copyright law anyway, but it was cool for the OP to point it out.

I heard about that guy. He is is trouble for self-publishing a sequel to Dawn of the Dead. I believe he is getting sued.
