Permission is needed. Probably most of the ones you are seeing are dollar baby projects.

Because Mr. King allowed people to buy the rights for $1 if they were student films.

He's been doing this since around 1977. It's his way of giving back for the enjoyment he's received from watching films to try to help out aspiring filmmakers--usually students.
